Judge Lets NAACP Clean Air Suit Against SpaceXAI's Memphis Turbines Proceed

A federal judge has refused to dismiss the NAACP's Clean Air Act lawsuit against SpaceXAI, the AI division of Elon Musk's SpaceX, over the gas turbines powering its Colossus data centers in Greater Memphis. The suit, filed in April 2026 in the Northern District of Mississippi by the Southern Environmental Law Center and Earthjustice, alleges that between August and December 2025 xAI and its subsidiary MZX Tech installed and ran 27 gas turbines in Southaven, Mississippi, without an air permit. The company argued in June that the turbines were “mobile” and exempt from permitting. The case now moves forward. Building AI compute at Musk speed keeps running into permitting rules written for another era — now the argument will be settled on the merits.
